Harassment Workshop

With more lawsuits going to court about harassment in the workplace, and the resulting legal liability and negative publicity that gives to your workplace, it's more important than ever to be sure that all your employees from upper management on down understand what harassment is and how to avoid it.
This Workshop defines and discusses physical, sexual, and verbal harassment. Whether done with the eyes, with words, or in a physical way, harassment of employees or customers by other employees or management can create problems that can shut your business down.

If in doubt about whether something you are doing or saying might be considered harassment, just don't do it.

IS IT HARASSMENT, OR NOT?
Harassment Likely Is:
1. Unwanted physical contact.
2. Unwanted staring or verbal comments of a sexual or physical nature.
3. Insinuated sexual comments or innuendo.
4. Physical threats of any kind.
5. Comments of a discriminatory nature clearly intended to harm.
Harassment Tip:
Essentially, harassment occurs when it is unwanted, meaning that if the person who feels harassed asks for comments or an activity to stop, it must. If you are doing something that someone else finds offensive, then you must cease. The test would be whether a reasonable person would judge that comment or activity as harassment. Harassment also occurs when a person of a supervisory role initiates comments or infers rewards based on sexual or other favors.
IF in doubt, don't do it. There is little "borderline" in harassment cases, so if it may be implied that you are participating in harassment, don't do it.

"Harassment" Defined:
This is not a legal definition, but generally: Workplace Harassment is unwelcomed written, physical, or verbal conduct that either downgrades or illustrates disapproval or creates a feeling of fear against someone on the basis of, among other differences: color, sex, race, religion, sexual orientation, age, disability, or national origin. IF it has the intent or effect of creating an offensive workplace situation for the person being harassed, or is hostile in intent, OR if it has the overall effect of affecting an employee's job or his or her performance in that job, or affects the employee's employment opportunities or pay level, it can be considered to be harassment.
